Provincial People's Committee issued a Decision on collaborative regulation on construction order management in the province. This Decision takes effect from 1 Mar 2020 and replaces Decision No. 37/2015/QD-UBND dated 7 Sep 2015 of Provincial People's Committee. Accordingly, the regulation stipulates responsibilities, mechanisms and contents of collaboration between Departments of Construction, People's Committees of districts, towns and cities (referred to as district People's Committees), People's Committees of communes, wards and townships (referred to as commune People's Committees), Binh Duong Industrial Parks' Management Board, Vietnam - Singapore Industrial Park Management Board, and other organizations and individuals involved in the management, collaboration for inspection and handling of violations of construction order in the province.
The regulation clearly states the responsibilities of persons competent to inspect and handle construction order violations, i.e. Chief Inspectors of provincial Construction Department, district-level and commune-level People's Committee Chairmen; responsibilities of Head of Binh Duong Industrial Parks' Management Board, Vietnam - Singapore Industrial Park Management Board.
Besides, the regulation also specifies the collaboration of construction order management: Agencies assume the prime responsibility for, and collaborate for construction order management; collaborate for inspection, examination and handling of works having granted construction permits or construction designs appraised or approved according to regulations; collaborate for inspection, examination and handling of works without construction permits but according to regulations must have construction permits; collaborate to monitor the construction work stoppage; collaborate to enforce decisions on administrative violation handling; implement forced demolition of construction works in violation of construction order; collaboration method of exchange and provision of information and documents; responsibility for settling complaints and denunciations about administrative violation handling in construction activities.
