The Presidential Office on July 16 made public the laws that were approved at the 13th National Assembly session in May and June 2012.
Taking effect in early 2013, the National Assembly’s approval of the Vietnam Maritime Law is an important law-making step to perfect the country’s legal framework to serve the utilization, management and protection of Vietnam’s sea and islands as well as the development of sea-born economy, so as to facilitate its international integration and boost its cooperation with other countries for the sake of peace and stability in the region and the world over
With seven chapters, 55 articles, the law was developed on the basis of Vietnam’s Constitution, the National Assembly’s Resolution on ratification of the 1982 United Nations Convention on the Law of the Sea (UNCLOS), statements of the Government in 1977 and 1982, summarization of Vietnam’s sea management and of the implementation of the UNCLOS, and inked sea-related agreements.
Taking effect from May 1, 2013, the amended Labor Code stipulates that the lunar New Year holiday (Tet) will increase from four to five days while the maternity leave will rise from four to six months.
Where a female gives birth to more than one child at one time, she shall be entitled to an additional one-month leave for every additional child calculated from the second child onwards.
The retirement ages remain unchanged with 60 years of age in case of males and 55 years of age in case of females.
The retirement age of an employee who works in heavy or toxic jobs, or in mountainous regions, in border regions, or on offshore islands, and in a number of other special cases shall be determined by the Government.
The Law on Deposit Insurance, with seven chapters and 39 articles, only allows insurance for deposit in Vietnamese dong (VND) by individuals.
Meanwhile, the Law on Anti Money Laundering, which will take effect from January 2013, stipulates that the prevention of money laundering activities to finance terrorism will be implemented under the regulations of this law, the Penal Code as well as legal regulations on anti-terrorism.
The Tertiary Education Law grants higher education establishments the right of self-control at the maximum level suitable for their capacity.
In the meantime, the Law on Tobacco Control prohibits people under 18 years old from using, selling and buying cigarettes.
The same day, the Presidential Office also promulgated other laws, including the Laws on Pricing, the revised Trade Union Law, the Law on Judicial Assessment, the Law on Dissemination of Laws, the Law on Dealing with Administrative Violations, the Advertising Law, the revised Law on Water Resources, the Resolution on tariff solutions to deal with difficulties of enterprises and individuals 2012 and the Resolution on the implementation of the Law on Dealing with Administrative Violations.
